Who we are

Our site is operated by the/2nd, a company registered in Spain, with its registered address at Valencia. You can reach us at hello@the2nd.net.

Using our site

You may use our site for lawful purposes only. You agree not to misuse it, interfere with it, or try to access it in any way other than through the interface we provide. We may change, suspend, or withdraw any part of the site at any time. If we give you an account or password, keep it confidential and tell us if you think someone else has used it.

Our products

We try to show our watches and their details as accurately as we can. Even so, colors and finishes can look slightly different on screen, and small variations are normal in a physical product. Each watch is described on its product page. All products are subject to availability, and we may change or stop offering a product at any time.

Prices

Prices are shown on the site in EURO and include applicable taxes unless stated otherwise. Delivery costs are shown separately before you place your order. For deliveries outside the European Union, you may have to pay import duties or taxes on arrival, which are not included in our prices and are your responsibility. We try to keep prices correct, but errors can happen. If we find an error in the price of something you have ordered, we will tell you and let you choose to continue at the correct price or cancel.

Orders

When you place an order, you are making an offer to buy. We will email you to confirm we have received it, but your order is only accepted, and a contract formed, when we email you to confirm that your watch has been dispatched. If we cannot accept your order, for example because an item is out of stock or there was a pricing error, we will tell you and will not charge you, or will refund you if you have already paid.

Payment

You can pay using the methods shown at checkout. Payment is handled by our payment provider, and we do not store your full card details. We take payment when you place your order, and your order is processed once payment is confirmed.

Shipping and delivery

We ship worldwide. Delivery times shown on the site are estimates and start once your order is dispatched. We are not responsible for delays caused by events outside our control or by the carrier. Risk in the goods passes to you when they are delivered to the address you gave us. If no one is available to receive a delivery, the carrier will follow its own process for redelivery or collection.

Your right to cancel

If you are a consumer in the European Union, you have the right to cancel your order within 14 days of receiving your watch, without giving a reason. To cancel, tell us clearly within that period, by email at hello@the2nd.net or using the contact details below. You then have 14 days to return the watch to us. You are responsible for the cost of returning it unless we tell you otherwise. We will refund the price you paid, including standard delivery, within 14 days of receiving the watch back, or of you showing us that it has been sent, whichever is sooner. We may reduce your refund if the watch has been used beyond what is needed to check it, or shows signs of wear. Consumers in other countries may have similar rights under their own law, which we honor.

Returns and exchanges

As well as your right to cancel, we accept returns and exchanges within 14 days of delivery for a change of mind. To be accepted, the watch must be unworn, in its original condition, with all packaging and any protective materials in place. Straps and items that have been worn or adjusted cannot be returned for a change of mind unless they are faulty. To start a return, contact us and we will explain the steps. None of this affects your legal rights if a product is faulty or not as described.

Warranty

Every the/2nd watch comes with a 2-year international warranty from the date of purchase, covering manufacturing defects under normal use. If a defect appears within that time, contact the retailer where you bought the watch, or, if you bought directly from us, contact us at the2nd.eu/help. The warranty does not cover:

• Batteries, straps, or bracelets.
• Damage from accidents or mishandling, including to strap buckles, bracelets, and the watch glass.
• Water damage where the watch has been used outside its water-resistance rating.
• Normal wear, or tarnishing of the strap, bracelet, or case.

This warranty is in addition to your statutory rights as a consumer and does not replace them. In the European Union, you are entitled to a legal guarantee of at least 2 years for goods that are faulty or not as described.

Caring for your watch

Our watches are water resistant to 3 ATM. This means they can handle splashes and rain, such as washing your hands or being caught in a shower, but they are not suitable for showering, swimming, bathing, or snorkeling. Water damage from these activities is not covered by the warranty. Our straps are quick-release and can be changed by hand without tools, using the2nd straps.

Your statutory rights

Nothing in these terms limits or affects the rights you have as a consumer under the law of your country, including your right to receive goods that match their description and are of satisfactory quality. Where those rights give you more protection than these terms, they apply.

Intellectual property

The the/2nd name, our logo, the forward slash mark, and all content on the site, including text, images, and design, belong to us or our licensors and are protected by law. You may not copy, reproduce, or use any of it for commercial purposes without our written permission.

Your content

If you post a review or other content on our site, you keep ownership of it, but you give us permission to use, display, and share it in connection with our business. You are responsible for what you post, and it must be lawful, honest, and your own. We may remove content that breaks these terms.

Acceptable use

You agree not to use our site to do anything unlawful, to introduce harmful code, to attempt to gain unauthorized access, or to disrupt the site or other users. We may suspend or end your access if you break these terms.

Our liability

We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for any consumer rights that cannot be excluded by law. Subject to that, we are not liable for losses that were not foreseeable, that arise from your own failure to follow our care guidance, or that relate to business use, since our products are sold for personal use.

Subject to that, and to the fullest extent permitted by law:

• We are liable only for losses that are a foreseeable and direct result of our breach. We are not liable for any indirect, incidental, or consequential loss, or for any loss of profit, income, data, or opportunity.
• We are not liable for losses that arise from your own failure to follow our care guidance or instructions, including the water-resistance limits set out above.
• We are not liable for losses relating to business, trade, or profession, since our products are sold to consumers for personal use.
• Our total liability to you for any claim connected with an order, however it arises, will not exceed the price you paid for the product the claim relates to.

Nothing in this section affects your mandatory rights as a consumer under the law of your country.

Events outside our control

We are not responsible for failing to meet our obligations where this is caused by events outside our reasonable control, such as extreme weather, strikes, carrier failures, or disruption to networks or supplies. If such an event happens, we will let you know and do what we reasonably can to limit the delay.

Links to other sites

Our site may contain links to other websites. We do not control them and are not responsible for their content. We provide the links for convenience only.

Changes to these terms

We may update these terms from time to time, for example to reflect changes in the law or in how we work. The version that applies to your order is the one in force when you placed it. Please check this page from time to time.

General

If any part of these terms is found to be invalid, the rest will still apply. If we do not enforce a right straight away, that does not mean we give it up. You may not transfer your rights under these terms without our agreement, though we may transfer ours if our business changes hands. These terms are the whole agreement between us about their subject.

Governing law and disputes

These terms are governed by the laws of Spain. If you are a consumer, you also keep the mandatory protections of the law of the country where you live, and you may bring a claim in the courts there. We hope to resolve any issue directly, so please contact us first. If we cannot settle it together, out-of-court dispute resolution may be available through a consumer dispute body in your country, and in cross-border cases through the European Consumer Centers Network.
